Alleged Cocoa Hit-and-Run Driver in Custody

After a brief investigation, officials arrested an 18-year-old man and charged him with vehicular homicide and leaving a crash scene involving death in connection with an April 20, 2026 collision.
Florida Highway Patrol troopers say the man was the driver of a 2022 Ford Mustang who caused a semi tractor-trailer to overturn when the Mustang collided with a Trailblazer SUV, pushing the car into the semi-truck’s pathway. The Mustang stopped momentarily after the collisions before continuing south on I-75, according to officials.
The driver of the Trailblazer was a 63-year-old Palmetto man who sustained minor injuries, while the semi-truck driver was a 34-year-old man from New Smyrna, Florida. The semi-truck driver sustained fatal injuries.
FHP investigators released a video of the suspect car later in the day which showed the Ford Mustang cut across the three lanes of southbound traffic to the far left lane moments before the crash. As brake lights flare, the Mustang then shifts over to the center lane, colliding with the Trailblazer.
The crash investigation continues as the suspect is being detained in the Manatee County Jail.
What is a Hit and Run in Florida?
Florida Statutes Section 316.061 and Florida Statutes Section 316.027 apply to all drivers involved in all crashes, not just at-fault drivers. Legal requirements include:
- Stop immediately at the accident scene, not a nearby “safe” location,
- Exchange contact and insurance information with everyone else involved in the accident, regardless of the amount of damage,
- Provide reasonable assistance if someone is injured, and
- Remain at the scene and cooperate with emergency responders until released from the scene (insurance adjusters usually don’t count as emergency responders).
In criminal court, the severity of a hit and run charge depends on the outcome of the accident, as well as the driver’s role in that accident:
- Property Damage Only: Usually charged as a misdemeanor, punishable by fines and possible jail time. “Innocent” runaway drivers usually face these charges.
- Injury to Another Person: The “injury” is usually an injury requiring emergency medical treatment. These cases are felonies.
- Serious Bodily Injury or Death: This first-degree felony has severe consequences, including mandatory prison time.
Additional punishments include drivers’ license suspension or revocation, extended probation, and restitution payments to victims.
Legal Defenses to Hit and Run Charges
For a Tampa criminal defense lawyer, identifying the driver is usually the critical issue in hit-and-run cases. The state must prove, beyond a reasonable doubt, that the defendant was behind the wheel at the time of the accident.
Eyewitness credibility could be an issue, especially if the witness was more than a few feet from the vehicle, the accident occurred at night, and/or other similar circumstances exist. Subsequent lineup identifications are often unreliable as well, especially if officers used a single-blind lineup (the administering officer knew the suspect’s identity).
Incidentally, under the Fifth Amendment, suspects have an absolute right to refuse to pose for pictures or appear in lineups.
To fill in the gaps, prosecutors often use electronic evidence, like surveillance footage. A Tampa criminal defense lawyer can exclude such evidence in many situations. Additionally, if prosecutors introduce other video evidence from another location, perhaps a few blocks away from the accident scene, it’s not easy to prove the two vehicles were one and the same.
Other defenses include lack of knowledge that an accident occurred and a medical emergency or other necessity.
