Traffic Stop Leads to Drug Bust

Two men are in custody after officers discovered several illegal items in their car during a March 2026 traffic stop in Monroe County.
At about 3:30 a.m., officers pulled over a speeding BMW on U.S. 1/Jimmy Buffett Memorial Highway in the Florida Keys, the sheriff’s office said. A deputy said the vehicle smelled like marijuana while a THC pen was in plain view, according to the release. During a subsequent search, deputies found a loaded .45-caliber Glock, more than 68 grams of cocaine, more than 21 grams of marijuana, seven prescription pills, and $641 in cash, the sheriff’s office said.
Both men were charged with cocaine trafficking, possession of a controlled substance without a prescription, and possession of drug paraphernalia. The driver was also charged with possession of a firearm by convicted felon and possession of ammunition by a convicted felon, the sheriff’s office said.
Initial Traffic Stops in Florida
Speeding at 3:30 in the morning is certainly unusual. However, unusual circumstances alone don’t justify traffic stops, at least in most cases.
Instead, officers must have reasonable suspicion to detain motorists. They must also have reasonable suspicion to conduct preliminary investigations.
Reasonable suspicion for the stop is usually not a problem. Courts have consistently held that even ticky-tack traffic violations, such as speeding 1mph over the limit, constitute reasonable suspicion. However, a Tampa criminal defense lawyer can challenge this point in some cases.
Courts have also consistently held that furtive movements, like nervously swerving into another lane when a squad car appears in the rear-view mirror, do not justify initial detentions.
Cart-before-the-horse profiling stops are another good example. As mentioned, driving on the freeway at 3:30 a.m. could arouse suspicion. But if officers tailed the BMW until the driver committed a ticky-tack traffic violation, the officer had a hunch justified by evidence, as opposed to evidence that supported a hunch. There’s a big difference between the two.
Profiling stops are another example. People work nights and stay out late. So, this BMW was probably not the only vehicle on the road. If the officer let other similar ticky-tack violations pass without a stop, the case for an illegal profiling stop is better.
DUI roadblocks are the primary exception to the reasonable suspicion rule. During a legal roadblock, officers may detain motorists based on a neutral formula (e.g. pulling over every fourth car that passes through the checkpoint), regardless of the driver’s behavior.
Initial Criminal Investigations
The presumed innocent rule applies at all stages of a criminal prosecution, not just at trial. So, until proven otherwise, a speeder is just a speeder, regardless of the time of day.
That’s one reason why it’s important for drivers to be on their best behavior during traffic stops. Kill the engine, roll down the window if possible, turn on the dome light, and put your hands at 11 and 1 on the steering wheel until the officer arrives at the window. Don’t give the officer an excuse to shine a flashlight into the vehicle and look for illegal items.
