Spotlight on Immigration Benefit Fraud

Spotlight

Immigration is at an all-time high, and so is immigration fraud, such as benefits fraud. These scammers use illegal tactics to obtain government benefits, usually visas and other documents, for immigrants.

Fraud hurts everyone, especially the immigrants who either perpetrate or fall victim to these scams. Sooner or later, immigration authorities almost always identify and punish scammers. As part of this punishment, courts immediately revoke any benefits that anyone illegally obtained as a result of the scam.

Many people resort to scams out of desperation. A Tampa immigration crimes lawyer removes this factor. Attorneys identify all possible options and help immigrants enter and remain in the United States legally and ethically.

Marriage Fraud

For thousands of people, the marriage visa is a shortcut to legal immigration. A few take this shortcut a little too far.

Legally, a sham marriage, the basis of immigration marriage fraud, is an association strictly for immigration purposes.

Frequently, investigators uncover marriage fraud during immigration interviews. Inability to recall relationship milestones, such as how they met or where they went on their first date, is a red flag. Inconsistent answers to these questions in separate interviews is another red flag.

Finally, investigators often focus on marriage and wedding preparations. If the ceremony is only a month or so away and the couple hasn’t booked a wedding venue or made cohabitation plans, more than likely, there will be no wedding or cohabitation.

Note that we said a sham marriage is “strictly” for immigration purposes. An impulsive marriage is not the same thing as an immigration sham marriage.

Asylum Fraud

Most people come to America to escape some kind of oppression. Asylum fraudsters usually exaggerate these stories to obtain asylum. Sometimes, they also fabricate evidence to support their tales.

Authorities take asylum fraud very seriously. Asylum laws protect individuals who face persecution because of their race, religion, nationality, political opinion, or membership in a particular social group. Fraud undermines this system because it allows people who do not qualify for protection to misuse legal processes intended for genuine refugees.

Common examples of asylum fraud include using false identities, fabricating stories of persecution, submitting forged documents, or working with dishonest consultants or Tampa immigration lawyers who create fake asylum claims. In some cases, criminal organizations coach applicants on how to present false stories during immigration interviews or court hearings.

Employment Fraud

While many people come to America fleeing oppression, others come to America looking for economic opportunity. Employment fraud hits at this reason for immigration. Common examples of employment immigration fraud include:

  • Claiming false job qualifications,
  • Citing fictitious job offers, and
  • Using fictitious companies to sponsor applications.

One attractive thing about employment fraud is that it often works in the short term. In many parts of Florida, employment visas are easier to obtain than other kinds of visas. However, these false statements never withstand even a minimal amount of scrutiny. After a few phone calls or Google searches, the employment application crashes down like a house of cards.

Material Misrepresentation

These individuals intentionally, not mistakenly, provide false or misleading information that could affect an immigration decision. A fact is “material” if it influences whether a visa, green card, asylum claim, or other immigration benefit is approved or denied. Examples include lying about criminal history, using a false identity, hiding prior immigration violations, or submitting fake documents.

Significantly, even if the application might have been approved without the false statement, the deception itself creates serious legal consequences. Largely for this reason, immigration authorities carefully review applications, conduct interviews, and verify records to detect fraudulent information.

"I was in the unfortunate situation of having to hire a lawyer for my grandson and since I did not know of anyone that could refer me, I had to rely on my judgement of character and when I sat down in front of Omar, I knew that I had made the right decision. He is a very professional, well versed in the law, knowledgeable young man that takes the time to explain every aspect of your case to you. He returns calls promptly, knows your case inside out and is very punctual in meetings and court hearings. I could not have chosen a better, more qualified lawyer to represent my grandson. He comes highly recommended by me and you will not go wrong in obtaining his services."

"It is with pleasure that we wish to recommend Mr. Omar Abdelghany in his practice as a Criminal Defense Attorney. He was hired in the defense of our son. The defense included more than one offense, which required legal maneuvering to address the issues. Omar's skills came into play in positioning the case, which resulted in a good outcome given the facts at hand."
