Florida’s Expanded Gang Statutes in 2026: Who Counts as a Gang Member Now

_GavelScales

Florida’s definition of a “criminal gang member” got wider on October 1, 2026. Under section 874.03(3) of the Florida Statutes, a person qualifies by meeting just two of 13 listed criteria. Several of those criteria describe ordinary behavior, like what someone posts online, who lives in their home, and who they get seen with. That makes the change worth understanding, even if you have never had a brush with the law.

What Changed This October

The Legislature amended the definition through Chapter 2026-156, Laws of Florida. The main changes include:

  • Admissions made online or on social media now count, not just those made in person.
  • Being claimed by a criminal gang as one of its members is a criterion of its own.
  • A spouse living with the person can now identify them as a member, alongside a parent or guardian.
  • Being seen with known gang members now takes two sightings instead of four.
  • Using “gang-related language” in furtherance of gang activity online is a new criterion. The statute defines that term as any statement that signals gang affiliation, supports gang activity, or uses recognized gang codes, symbols, or terminology.

One older feature deserves fresh attention. When a single act satisfies more than one criterion, the statute treats each of them as met. In theory, one social media post could check more than one box.

Why the Label Matters

The label does not automatically enhance a sentence. Section 874.04 requires a finding, beyond a reasonable doubt, that the defendant committed the charged offense to benefit, promote, or further the interests of a criminal gang. When that finding is made, the penalty may go up one level. A third-degree felony can be punished as a second-degree felony, a second-degree as a first-degree, and a first-degree as a life felony.

Gang status also shows up elsewhere. It is an aggravating factor in capital sentencing under section 921.141(6)(n), and county detention facilities may assess inmates for gang status under section 951.23(11) and report it to the arresting agency.

Where a Defense Pushes Back

The statute has its own built-in limit. In section 874.02, the Legislature wrote that the chapter is not meant to interfere with constitutionally protected freedom of expression and association. That matters when the evidence is a slang-heavy post, a song reference, or a photo with an old friend.

Experienced Tampa organized crime attorneys look closely at how the State proves each criterion. Who made the identification, and how reliable are they? Does an informant have a documented track record, or is the tip untested and uncorroborated? Was the tattoo or style of dress actually tied to a specific gang, or does it only resemble something that might be? And is a post truly gang-related language, or just the way a teenager talks?

Those questions can shrink or eliminate a gang designation, along with a sentencing enhancement that might add years to a case.

If a gang label or enhancement appears in your paperwork, we want to hear about it before it shapes the rest of your case. OA Law Firm offers free consultations around the clock, so call or send us a message and we will start reviewing the evidence with you.
