Methamphetamine Charges

Drug arrest

Drug addiction continues to remain a serious issue in American society. Because of this, the penalties for drug related offenses can be especially harsh. In some regions, like Florida, crimes that involve methamphetamine (meth) are quite common. If you are convicted of possessing meth then you will likely be fined, face incarceration, and you may be left with a permanent criminal record. This may disqualify you from many different types of employment and make it difficult to obtain housing or loans in the future. Omar Abdelghany is a Tampa criminal defense lawyer who handles these matters throughout Florida's Tampa Bay. If you need assistance then call our office today for an initial consultation.

Tampa, Florida Attorney Handling Cases Involving Methamphetamine or “Meth”

Florida has classified methamphetamine, or “crystal meth” as it is commonly referred to, as a Schedule II controlled substance. This means that the mere possession of meth is a third degree felony. Defendants convicted of a third degree felony can face up to five years in prison and a fine of up to $5,000. However, if the total weight of the product exceeds 14 grams then the defendant will be charged with drug trafficking and could face a mandatory-minimum sentence. If the narcotic is taken across state lines then the accused may also face federal criminal charges.

Methamphetamine cases begin with the defendant entering a “not guilty” plea after the Judge has found that there is probable cause supporting the charges. Under our state's speedy trial laws, the matter will be set for a date within 175 days. As with other drug possession cases, matters involving meth often revolve around whether the evidence was obtained through law enforcement's violations of one's rights. If the defense lawyer believes that such a violation occurred then they will file a Motion to Suppress the evidence. If this Motion is successful then the drugs will be inadmissible in Court and, depending on the circumstances, the charges may be dismissed. If a dismissal or negotiation is not obtained then the case will be taken to trial. A jury will decide the issue of guilt or innocence. These matters can involve complicated constitutional and evidentiary issues. It is important to retain experienced counsel.
